Cross-Border Used Vehicle Trading Terms
1. Vehicle Inspection and Condition
The Platform inspects vehicles only for major accident damage, fire damage, and flood or water damage. The inspection is a visual inspection conducted, at the time of inspection, without dismantling any component or placing the vehicle on a lift, and is limited to readily visible areas. It does not cover the engine, transmission, underbody, chassis or suspension components, interior, sunroof, or any other item not expressly listed in the inspection report.
The inspection report reflects only the condition of the vehicle, within the agreed inspection scope, at the time of inspection. It is provided solely as a reference for the Buyer's purchasing decision and does not constitute any warranty regarding the vehicle's overall condition, quality, performance, service life, merchantability, or fitness for a particular purpose.
Except for the major accident, fire, and flood or water-damage items expressly stated in the inspection report, all other aspects of the vehicle are sold AS IS, WHERE IS. Neither the Platform nor the Seller provides any express or implied warranty.
If the vehicle already had major accident damage, fire damage, or flood or water damage at the time of inspection and its actual condition is materially inconsistent with the inspection report, the Platform will provide reasonable compensation based on the severity of the issue and the Buyer's direct loss. The maximum compensation shall be the lower of 10% of the vehicle price or USD 1,000. The vehicle price excludes transportation charges, insurance premiums, taxes, customs-clearance fees, bank charges, and any other third-party costs.
The Buyer must submit any claim within 10 calendar days after the vehicle actually arrives at the destination port, and the vehicle's mileage must not exceed the mileage stated in the inspection report or vehicle listing by more than 50 kilometres. The Buyer must promptly provide photographs clearly showing the issue, one continuous and unedited video, the chassis number or VIN, and the odometer reading. Without the Platform's prior written consent, the Buyer must not repair, dismantle, modify, resell, or otherwise alter the condition of the vehicle. Otherwise, the Platform may reject the claim.
2. Order Cancellation, Vehicle Return, and Refund
The required deposit is USD 500 and is non-refundable. If the Buyer decides not to proceed with the current vehicle due to concerns about its condition, subject to confirmation by the Platform, the deposit may be transferred and applied as the deposit for another vehicle offered on the Platform. The deposit may not be withdrawn or returned in cash or through the original payment method.
Once the Buyer has paid the vehicle price, the order may not, in principle, be cancelled, and the vehicle may not be returned or refunded.
If, after the deposit has been paid but before the remaining balance is paid, the Platform's reinspection identifies a material discrepancy between the vehicle and the original inspection report concerning major accident damage, fire damage, or flood or water damage, the Platform will notify the Buyer. The Buyer may choose to proceed with the purchase or select another vehicle, with the deposit transferred and applied in accordance with the first paragraph of this Section.
Except in the circumstances described above or where otherwise required by mandatory law, no vehicle may be returned or refunded after sale.
3. Delivery, Transfer of Risk, and Transportation Insurance
All vehicles are sold under the EXW term, with the vehicle's location serving as the default place of delivery.
Notwithstanding the use of the EXW term, the parties expressly agree that the risk of loss, damage, delay, and all other transportation-related risks transfers to the Buyer after the vehicle is handed over to the first domestic carrier and domestic transportation begins.
The Platform will arrange the purchase of applicable transportation insurance for the Buyer. If transportation damage falls within the insurance coverage, the Platform will assist the Buyer in submitting a claim to the insurer and, as required by the insurer, assist in arranging repairs. Whether a claim is paid, the scope of coverage, and the amount payable are subject to the insurance policy and the insurer's final determination. The Platform does not guarantee that the insurer will pay any claim.
Damage occurring during transportation is not considered a discrepancy in the vehicle inspection report and must first be handled through the transportation-insurance claim procedure.
4. Customs Clearance and Collection at the Destination Port
After the vehicle arrives at the destination port, the Buyer must promptly complete customs clearance, pay applicable taxes and duties, and collect the vehicle.
Any storage charges, container demurrage, port demurrage, penalties, vehicle-disposal charges, or other related costs caused by the Buyer's failure to complete customs clearance, make payment, or collect the vehicle on time shall be borne by the Buyer.
5. Governing Law, Dispute Resolution, and Language
This transaction and the related Platform terms are governed by the laws of Mainland China. The United Nations Convention on Contracts for the International Sale of Goods (CISG) is excluded.
Any dispute shall first be resolved through good-faith consultation. If no resolution is reached, either party may bring proceedings before a competent People's Court at the place where the Platform operator is located.
The vehicle listing, inspection report, order, invoice, and Platform terms together form the basis of the transaction between the parties. If their contents are inconsistent, the Platform's official trading terms and the order shall prevail.
The English versions of all vehicle information, vehicle-condition descriptions, inspection reports, orders, and trading terms published by the Platform are controlling. Versions in any other language are provided solely for the Buyer's convenience and for reference. In the event of any inconsistency, ambiguity, or conflict between language versions, the English version shall prevail.
